Passenger Safety Waiver
CastOff Standard Maritime Waiver (v1.4, 28 September 2026) — applicable to all charter bookings made through CastOff
1. Acknowledgement of risk
I understand and acknowledge that recreational fishing charters involve inherent risks including but not limited to: rough sea conditions, adverse weather, vessel motion causing seasickness or loss of balance, exposure to sun and elements, handling of fishing equipment and hooks, contact with marine life, and the risk of falling overboard. I voluntarily accept these risks as a condition of participation.
2. Fitness to participate
I confirm that I am physically fit to take part in a recreational fishing charter. I have told the skipper, in my waiver details, anything about my health they should know to keep me safe, including any relevant medical conditions, disabilities or medications. I understand that the vessel's skipper has the final authority to refuse boarding to any passenger they reasonably believe poses a safety risk.
3. Compliance with safety instructions
I agree to follow all safety instructions given by the skipper and crew at all times. I understand that the skipper's decisions regarding vessel operation, fishing locations, and trip duration are final and made in the interests of passenger safety. I agree not to interfere with the operation of the vessel or the duties of the crew.
4. Alcohol and substances
I understand that the consumption of excessive alcohol or use of illegal substances is prohibited on board. The skipper reserves the right to refuse boarding or remove any passenger who is intoxicated or under the influence of substances, without refund.
5. Limitation of liability
To the maximum extent permitted by Australian Consumer Law, I release Cast Off Co (ABN 38 353 817 791), the charter operator, the vessel owner, and their respective employees, agents, and contractors from any liability for injury, illness, death, loss, or damage to property arising from my participation in the charter, except where such liability cannot be excluded by law. Nothing in this waiver limits any rights I may have under the Australian Consumer Law.
6. Weather and cancellation
I understand that trips may be cancelled or modified due to weather conditions, mechanical issues, or other safety concerns at the skipper's discretion. Weather and operator-initiated cancellations are fully refunded through CastOff. I agree to the operator's cancellation policy as displayed at the time of booking for customer-initiated cancellations.
7. Fishing regulations
I agree to comply with all applicable Australian and state fishing regulations including bag limits, size limits, and species-specific rules. I accept responsibility for my compliance with these regulations and understand that the operator or CastOff bears no responsibility for any regulatory breaches by passengers.
8. Photography and media
I consent to photographs and video being taken during the trip for potential use by the operator or CastOff in promotional materials, unless I notify the operator otherwise before departure.
9. Personal belongings
I understand that CastOff and the operator accept no responsibility for loss, theft, or damage to personal belongings brought aboard the vessel.
10. Passenger manifest
I understand that my name, my confirmation that I am 18 or over (or, for a child, their parent or guardian's details), and my group's emergency contact are included in a passenger manifest for maritime safety compliance, as required under Australian maritime law. This information may be provided to maritime authorities if required.
11. Governing law
This waiver is governed by the laws of the Australian state or territory from which the charter departs. If any provision of this waiver is found to be unenforceable, the remaining provisions continue in full force.
12. Acceptance
This waiver is accepted electronically and individually: each person accepts it only for themselves. Every passenger, including the lead passenger, signs it before departure on their own phone, using their personal waiver link or QR code; a passenger who has no phone with them may sign it themselves on the crew's phone. Nobody signs on another person's behalf, except that a parent or legal guardian signs for their own child under 18. The signatory's name, the time, and whether it was signed on their own phone or the crew's are recorded against the booking reference.
