1. About CastOff
CastOff is an online marketplace operated by Cast Off Co (ABN 38 353 817 791), a sole trader registered in Australia. CastOff connects customers with independent fishing charter operators across Australia. CastOff acts as an intermediary between customers and operators and is not itself a charter operator.
2. Acceptance of terms
By accessing or using CastOff, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform. These terms apply to all users including customers, charter operators, and visitors.
3. Bookings and payments
When you make a booking through CastOff, you are entering into a contract directly with the charter operator, not with CastOff. CastOff takes the booking and payment for the operator. The price shown at checkout is the full price of your trip. CastOff does not charge customers a booking fee or a surcharge, and the price is the same whatever payment method you use. CastOff's commission is paid by the operator out of the trip price. At checkout you pay a 50% deposit, or the full price if you book within 72 hours of departure. The operator decides how you pay the balance: through the secure payment link we send you, or directly to them by cash or bank transfer. Card payments are processed securely by Stripe. By completing a booking, you agree to the operator's cancellation policy, which is shown at checkout.
4. Cancellations and refunds
If the operator declines your booking request, or cancels your trip for weather, safety, or any reason other than your breach of these terms, you receive a full refund. If the operator hasn't answered your booking request within 24 hours, you can withdraw it for a full refund. Cancellations by customers are subject to the operator's cancellation policy, which is displayed clearly before payment. CastOff reserves the right to cancel bookings in exceptional circumstances and will provide a full refund in such cases. Refunds are processed by Stripe and typically appear on your original payment method within 5–10 business days.
5. Customer responsibilities
Customers must provide accurate personal information including emergency contact details and any medical conditions relevant to participation in maritime activities. Customers must follow all safety instructions given by the operator and crew. Customers who are under the influence of alcohol or drugs may be refused boarding without refund. Customers must comply with all applicable fishing regulations and licensing requirements.
6. Operator responsibilities
Charter operators listed on CastOff must hold all required licences, certifications, and insurance as required by Australian maritime law. Operators are responsible for the safety of all passengers and must comply with all relevant regulations. Operators must honour bookings made through CastOff unless cancellation is due to weather or genuine safety concerns. Operators are responsible for the accuracy of their listing information.
7. Safety waiver
Fishing charters involve inherent risks including rough weather, physical exertion, and maritime hazards. By completing a booking, customers acknowledge these risks and agree that CastOff and the operator are not liable for injury, loss, or damage arising from participation in charter activities, except where such liability cannot be excluded by law. 8. Limitation of liability
To the extent permitted by law, CastOff's total liability to you in connection with a booking or your use of the platform is limited to the amount you paid through CastOff for that booking. CastOff is not liable for the acts or omissions of charter operators. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
9. Intellectual property
All content on the CastOff platform including text, images, logos, and software is owned by or licensed to Cast Off Co and may not be reproduced without written permission. Reviews submitted by users are licensed to CastOff for display on the platform.
10. Changes to terms
CastOff may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. We will notify registered users of material changes by email.
11. Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland.
